STANDARD TERMS AND CONDITIONS

Purpose

The purpose of this Agreement, "Service" or "Services", means the remediation procedures described on this website. Services may be provided directly by Shire Mould Removal (SMR) or indirectly through agent arrangements SMR has made with third parties. By using or paying for the Service, you agree to the terms and conditions in this Agreement, including service-specific terms of Service referenced herein, and that disputes will be resolved by individual arbitration. We encourage you to review the applicable service terms and conditions as they contain important information about your rights and obligations and ours. References to "Shire Mould Removal", "SMR", "we", "us" and "you" include our respective subsidiaries, affiliates, agents, employees, predecessors in interest, successors, and assigns, as well as all authorised or unauthorised users or beneficiaries of FMR Service under this or prior agreements between our predecessors in interest or us. "CLIENT" or "client" refers to the person, group of people, entity or company requesting the remediation work.

 

Scope 

The Scope of the inspection is limited to the readily accessible areas of the property and is based upon the condition of the property at the precise time and date of the inspection. The customer and the inspector will set the Scope of the review prior to the commencement of the inspection. Mould can exist in inaccessible areas such as behind walls and under carpeting. Furthermore, mould grows. As such, the report does not guarantee that mould does or does not exist. The report is only indicative of the presence or absence of mould during the time of the inspection and on the inspected areas. SMR makes every effort to point out conditions that may contribute to mould growth within a basic mould inspection. Suppose the Client chooses not to pay the basic inspection fee and has requested that only sampling be conducted. All other conditions such as moisture conditions and causes will not be considered or reported upon.

 

Report

If requested the Client will be provided with a written report based upon the Scope of the inspection earlier decided upon by the Client and SMR. This report may include the visual observations of the inspector based upon the basic Mold inspection, or it may only provide the laboratory analysis of the samples taken, or it may include both. The inspection company is not able to determine the extent or type of microbial contamination from visual observations alone. 

 

Exclusivity

The report is intended for the Client's sole, confidential and exclusive use and benefit, and the inspection company has no obligation or duty to any other party. The inspection company accepts no responsibility for use by third parties. There are no third-party beneficiaries to this Agreement. This Agreement is not transferable or assignable. Notwithstanding the foregoing, the Client understands that the inspection company may notify the homeowner, occupant or appropriate public agency of any condition(s) discovered that may pose a safety or health concern.

 

Limitation of Liability 

The inspection and report, and treatment are not to be construed as a guarantee or warranty of any kind. The Client agrees to hold the inspection company and their respective officers, agents and employees harmless from and against any and all liabilities, demands, claims, and expenses incident thereto for injuries to persons and for loss of, damage to, destruction of property, cost of repairing or replacing, or consequential damage arising out of or in connection with this inspection. 

Pretreatment Requirements

 SMR shall provide all the services, equipment, supplies, materials, and labour required to remediate, treat mould-contaminated components and dispose of all waste to the best of SMR's ability and knowledge.

  1. All work shall be done under the direct supervision of a technician with training in mould remediation.

  2. Trained individuals shall conduct all work.

  3. The remediation works will be carried out at SMR standard rates as detailed on the website. If the treatment is not in line with SMR standard rates, SMR shall coordinate and prepare a fee proposal to be approved by the Client before conducting the remediation at the site. 

  4. If requested SMR shall provide copies of all MSDS for any chemicals and other products that will be brought on-site and used during this project.

 

General Notes

Mould Treatments cannot stop mould. Mould is the symptom or a moisture issue in the area where mould is visibly present. Poor drainage, poor ventilation, roof links and high humidity can lead to mould growth. If the root cause of the mould is not addressed, mould will continue to grow. We do not carry out any structural, ventilation or plumbing works. We only treat the mould that is present at the time of inspection. SMR will provide general advice in relation to:

  • Drainage

  • Ventilation

  • Roof and wall leakage

  • Dehumidification

  • Rising damp

  • Other seepage 

Mould is stopped by reducing high moisture levels. SMR will typically treat the visible mould and then assist you in reducing the moisture content. When considering if SMR treatment is suitable for you, the below must be acknowledged and considered carefully:

  • Only accessible and exposed areas will be treated.

  • For SMR to properly treat the mould affected areas the mould needs to be readily accessible. It is the responsibility of the Client to make all areas and mould affect surfaces accessible prior to the treatment.

  • SMR can not treat mould in wall and roof voids unless made fully accessible.

  • Our technicians will not move furniture to assess mould affected areas. 

  • Windows may require a general clean over after the treatment as our products may cause smearing on glass. Window cleaning after fogging treatment is not included.

  • We do not carry out mould sampling or laboratory testing. 

  • We do not provide certificates for insurance or lease purposes. Certificates are not included in our standard rates.

  • SMR will only treat mould affected areas that are indoors. External wall roofs or floors of houses will not be treated.

  • Unsealed surfaces will often retain mould staying in particular surfaces with visible voids or porous surfaces. SMR treatment's effectiveness will vary on these surfaces. In some cases, these affected surfaces may need to be removed from the dwelling completely to remove the mould.

  •  Painted areas, Wallpaper products, paint having bright/deep pigments, poor quality and porous, damaged paint surfaces can be affected by the mould treatment process. We take care to avoid damage, but we take n but no responsibility if staining, discolouration or damage occurs to any permanent or impermanent component of the dwelling. 

  •  When Fogging treatment only is carried out, this is a mould spore killing process. This process does not remove mould staining. Mould stains will still be visible after the fogging has been carried out. 

Our Fogging treatment is safe, non-toxic, extremely low irritant and has very little odour. The active ingredient used in our fogging is Tea Tree Oil. Typically fogging leaves a slight residue and no damage to furniture, walls, floors and ceilings. However, fogging may damage or stain these surfaces. Following fogging, we do not carry out any cleaning of surfaces. If cleaning is required, please carry out cleaning using standard cleaning methods manufacturer's recommendations should be followed.

 

Warranty

  1. All work is to be performed in a workmanlike manner with industry standards.

  2. It should be noted that mould conditions can change over short and extended periods of time and may vary and depend upon several factors notwithstanding ventilation, humidity, disturbance, temperature, etc. I/we also understand that the liability of the inspector for damages arising from action or inaction, however, caused, is limited in amount to the fee paid for this inspection. If the mould present at the time of treatment at the treatment areas is not treated correctly by SMR, the fee charged for the treatment will be refunded. The Client must notify SMR within one week from the time of treatment the treatment has not been effective.

  3. In all situations, the underlying cause of water accumulation must be rectified, or fungal growth will recur. For these reasons, FMR does not guarantee against the recurrence of mould growth.
